Delware County Judge Approves $2.76 Million Settlement In Travel Agent Overtime Class Action

A Delaware County judge has approved a $2.76 million settlement in a class action brought by travel agents against Liberty Travel, Inc. and its former officers.  The lawsuit involved claims of unpaid overtime wages.   

Common Pleas Judge Charles B. Burr, II’s opinion determined that the settlement was “fair, reasonable and adequate” after a September 12 settlement hearing.  The opinion also noted that by settling, Liberty Travel and the other defendants admitted no wrongdoing.   

More than $1.7 million of the total will be paid to the 564 Liberty Travel agents comprising the class.

Lead counsel for the class in Linda Welsh v. Liberty Travel was Mark A. Sereni of the Media law firm of DiOrio & Sereni, LLP.  Class co-counsel was Andrew J. Reilly of Swartz Campbell LLC, joined by Donna M. Albani.  Liberty Travel was defended by Judith E. Harris and Joseph B. G. Fay of Morgan Lewis, and Murray S. Eckell of the Media law firm of Eckell Sparks.       

Judge Burr also approved more than $950,000.00 in legal fees and expenses to be reimbursed by the defendants to class counsel.
