Commonwealth Court affirms victory in county-wide test case protecting rights of all taxpayers to equalized taxes
In a unanimous January, 2012 decision, the Commonwealth Court has upheld a trial court’s decision in a county-wide test case in which Mark A. Sereni, Gregory S. Gerson, Esquire and the law firm of DiOrio & Sereni, LLP served as lead counsel for the victorious party.
As the trial court did, the Commonwealth Court soundly rejected wealthy property owners' attempt to employ a much lower common level ratio (CLR) and thus generate a much lower real estate tax assessment and corresponding real estate tax. Also as the trial court did, the Commonwealth Court likewise soundly rejected the property owners' attempt to impose a county-wide reassessment upon each and every school district and municipality across Delaware County, a huge undertaking that would have cost the taxpayers millions of dollars.
